For an executor, the task of settling an estate can be stressful, challenging, and time-consuming, let alone knowing where to begin.
Questions may arise on where to start, what and when to take action, which order of tasks to do, who to call, and how to complete the extensive paperwork.

WHAT THIS INVOLVES?

It entails countless hours of searching, gathering, and contacting various government and private organizations to inform them of the passing of their dear one.

The task also involves completing benefit applications, applying for Estate Grants, and other fiduciary duties.

WHY START SOON?

It’s important to begin the process soon after a dear one’s passing. Prevent fraud and posthumous identity theft. It’s a real problem in this digital age!

Take time to grieve, but don’t risk extra stress, costs, and complications with extended delay.

It generally takes around one year to obtain an inheritance and distribute the assets to beneficiaries under the will, depending on the size and complexity of a probate application.

We develop a custom plan tailored to your situation.  That includes a step-by-step guide and checklist of key tasks to accomplish.

RESOURCES

We can provide you with resources that offer relevant information on deceased taxes and Do-It-Yourself (DIY) BC estate grant applications: Grant of Probate or Grant of Administration with or without Will Annexed. 

If you are up to DIY tasks, you can prepare the deceased final tax return and estate grant application.  This option would Save You Money.

 

If you are not up to DIY tasks and require help with legal or tax advice, we can refer you to a qualified professional who can assist you.

Probate is a process to obtain the court’s confirmation on the validity of a deceased’s final will under B.C. laws and to authorize the executor to administer the estate.

 

The grant of probate gives the executor the legal authority to act on the will and manage the deceased’s estate.  It protects the executor against claims under a competing will.

 

Without a Grant of Probate, a deceased’s assets cannot be claimed, transferred, sold, or distributed.

 

The executor may also have to pay out of pocket for assets distributed if a claim is made later that the will is invalid.

 

The Supreme Court of BC requires a Grant of Probate or Administration submission for a deceased’s estate that exceeds $25,000 in value.

 

Generally, assets that pass outside the will, such as those held in joint tenancy or have a designated beneficiary do not form part of the deceased’s estate. 

 

However, there may be circumstances where joint tenancy  assets can form part of the deceased’s estate.

 

If you are not sure of your dear one’s estate value or what assets are subject to probate, we can refer you to a qualified tax and/or legal professional who can assist you.

 

Estate assets worth less than $25,000 generally do not require probate.

 

However, certain agencies, and financial institutions may need a Grant of Probate or Administration before releasing a deceased’s assets to an executor or administrator for distribution to beneficiaries under the will.

 

Grant of Administration with or without Will Annexed

  • Grant of Administration without Will Annexed (when the deceased has no valid will – intestacy estate)
  • Grant of Administration with Will Annexed (when the deceased has a will, but no appointed executor or executor has renounced or passed on – partial intestacy estate)
